Belmar DWI Lawyer
Belmar New Jersey is a beautiful town located along the Jersey Shore. The town is home to many bars and restaurants. The local police in Belmar charge numerous individuals with DWI each month. DWI or driving while intoxicated is governed by New Jersey statute 39:4-50. The penalties for DWI can be significant. They can include a license suspension, community service and in some cases jail time.
Officers at the Belmar police department patrol Belmar using police cars and bicycles. Additionally, some officers patrol on foot. In some circumstances, an individual can be stopped for DWI by an officer who is riding a bicycle. This typically occurs when an individual stops at a stop sign or cross street. In New Jersey, a police officer is able to effectuate a lawful motor vehicle stop even if that officer is patrolling on a bicycle or on foot. The way in which the officer decided to stop the vehicle is not grounds to challenge the motor vehicle stop. However, an officer who does stop a vehicle must always have reasonable suspicion to make that vehicle stop regardless of how that officer encounters the driver. If the officer does not have sufficient reasonable suspicion to believe that either a traffic offense or criminal offense is occurring or has occurred, that stop may be deemed an unlawful stop and everything that occurred after the unlawful stop may be suppressed. In a DWI matter this means that the post stop observations, field sobriety tests and chemical tests may be suppressed. Suppressed means that the evidence cannot be used in court. If all post stop evidence and observations are suppressed a DWI charge will be dismissed.
