Gun charges in Middlesex County as well as the entire state of New Jersey carry very significant penalties.  Gun charges are typically second degree crimes though in some circumstances they can be crimes of the first degree.  A second degree crime carries a state prison term between five and ten years.  A first degree crime carries a state prison term between ten and twenty years.  If an individual is convicted of either a first or second degree crime, they are presumed to receive a state prison sentence.  However, in some circumstances, the prosecutor and defense attorney can agree that a lessor penalty is appropriate and an individual can receive probation as sentence to a gun charge conviction.

Unlawful Possession of a Weapon and Possession of a Weapon for an Unlawful Purpose

Possession of a weapon for an unlawful purpose is codified under New Jersey statute 2C:39-4.  Unlawful possession of a weapon is codified under New Jersey statute 2C:39-5. If an individual possession a gun for an unlawful purpose they will be guilty of a crime of the second degree.  Additionally, unlawful possession of a gun is also a crime of the second degree.  If an individual is convicted of both of these crimes at sentencing they may be sentenced to consecutive terms between five and ten years in a New Jersey state prison.  Consecutive terms means that each sentence will have to be served separately, one after the other.  Therefore, if an individual is sentenced to six years in New Jersey state prison for unlawful possession of a weapon and six years in New Jersey state prison for possession of a weapon for an unlawful purpose, and the sentences are to run consecutively, the individual may have to serve up to twelve years in a New Jersey state prison.
