The penalties for DWI in New Jersey, which obviously includes the potential penalties if an individual is convicted of DWI in Manalapan, include license suspension, community service and jail time. The specific penalties vary depending upon how many prior convictions the individual has. For a first offense DWI conviction, an individual will lose his or her license for a period between three months and one year depending upon the individual’s blood alcohol content at the time of the offense. If an individual is convicted of a second offense DWI, that individual will face two years loss of license and a potential short jail sentence depending upon various factors. For a third offense DWI, an individual will face a minimum of ten years loss of license and will be incarcerated for six months in the county jail. The jail term for a third offense is a mandatory penalty. This means if an individual is convicted of DWI they will be sentenced to six months in the county jail. a Municipal Court Judge must impose this sentence after a conviction. However, if the DWI charge is dismissed, the individual will not face the jail term and license suspension associated with a third conviction. If an individual is convicted of a fourth DWI, they will face the same penalties as a third offense. Under New Jersey law, each conviction after a third offense DWI carries the same mandatory minimum penalties which are six months in the county jail as well as a ten year loss of license.
