Penalties for DWI in New Jersey

Wall New Jersey Criminal Defense Attorneys serving Monmouth County, Ocean County, Middlesex County and all surrounding NJ areas.

Penalties for a DWI matter in the state of New Jersey can be very significant. Depending upon the blood alcohol content of the individual at the time when they are operating their motor vehicle and or the amount of prior DWI convictions the individual has, a DWI in New Jersey can carry  a significant term of license suspension, jail time, fines, community service and other penalties. If you or someone you know has any questions about New Jersey DWI Penalties call our New Jersey DWI Defense Attorneys today. Our lawyers represent individuals who have been charged with DWI throughout the state of New Jersey including DWI’s which occur in the towns of Wall and Middletown, New Jersey.

In New Jersey, DWI offenses carry more significant penalties depending upon the amount of times an individual has previously been convicted of DWI. Under the statute, N.J.S.A. 39:4-50, there are three separate broad ranges of penalties for driving while intoxicated.

All of the above offenses can carry a license suspension and in some circumstances jail time. If any individual is convicted of a third offense DWI, they will face mandatory jail time.

Obviously, the best way to deal with DWI penalties is to litigate and challenge the proof in a DWI matter.  Under the attorney general guidelines, a DWI cannot be plea bargained or reduced. However, this does not mean that an attorney cannot find legal insufficiencies or challenge the evidence or order to obtain the dismissal of a DWI charge. If a DWI charge is in fact dismissed, the individual will not face any of the penalties that are associated with a DWI matter.

If you or someone you know would like to do discuss all of the potential penalties with a qualified DWI defense attorney call our office or click on the chat icon on this webpage. Our attorneys will take the time to discuss your DWI charge with you. If you decide to retain our firm we will aggressively defend you in your DWI matter.
