Often times a gun charge arises out of a motor vehicle stop. An individual may be stopped for a traffic offense. Once stopped for the traffic offense, police may discover that the individual is in possession of a gun. This can occur because police saw or discovered the gun or the operator of the vehicle told police about the gun. Either way, if the individual does not have a New Jersey issued permit to carry a firearm, they will be charged with possession of a gun. Specifically, they will likely be charged with unlawful possession of a weapon. Sometimes a defense to a possession of a gun charge is challenging the way in which the police recovered the gun. This may be done through the filing of a motion to suppress. During a motion to suppress, the defense may be able to challenge the reason for the motor vehicle stop in the first place and or the reason that the officer discovered the gun. If the defense decides to challenge the reason the vehicle was stopped, the defense will be alleging that the police officer did not have reasonable suspicion to stop the vehicle for either a traffic or criminal offense. If the defense is successful in demonstrating to a Judge that the police officer did not have lawful reason to stop the vehicle, all evidence which was discovered, including the gun, will be suppressed as fruit of the poisonous tree. Evidence which is deemed fruit of the poisonous tree will not be able to be entered into evidence in the prosecution of the individual and any gun charge will likely be dismissed.
