Sometimes auto accidents are just that—accidents. Unfortunately, these incidents often involve severe injuries and fatalities, which may lead to criminal charges such as vehicular homicide. That was the case for our client, Bryant Almanzar of Secaucus, New Jersey, after he fatally injured a pedestrian in February of 2015. Almanzar faced up to 10 years in prison if convicted, and our attorneys were able to achieve a not guilty verdict for Almanzar in early December.
There were a few aspects of this case that could not be proven through the accident investigation or expert testimony. The prosecution tried to assert that Almanzar was driving drunk when he struck the pedestrian, even though a blood test confirmed his BAC (blood alcohol content) was .036—less than half of the legal limit in New Jersey.
Determining the speed of Almanzar’s vehicle was an important step in reaching the not guilty verdict. An accident investigation by the State of New Jersey attempted to verify that the car was going well over the speed limit of 25mph. However, testimony from an engineer on behalf of Almanzar contradicted the state’s conclusion, stating it wasn’t possible to accurately determine the speed of the vehicle at the time of the accident.
Ultimately, the jury was able to reach the conclusion that Almanzar was not guilty of reckless driving or driving while intoxicated and that it was an awful accident, not vehicular homicide.
