Jersey City is one of New Jersey’s largest cities. The Jersey City Police make arrests for various violations of the law including drug offenses. Depending upon the specific drug and/or amount, penalties for drug offenses can range from probation to more than ten years in prison.
Drug offenses include possession of:
- Marijuana
- Cocaine
- Heroin
- Prescription drugs
- Ecstasy
Drug charges can also include possession of drugs with intent to distribute and/or drug distribution. Though similar, these offenses are different. Possession with intent to distribute means the individual possessed the drugs, and based upon the quantity or the way in which the drugs were possessed, the state believes the individual possessed these drugs with the intent to sell them. Drug distribution means that the state has evidence, which it believes establishes that the individual charged did in fact distribute and/or sell drugs.
Fighting Your Drug Charges
There are various potential defenses to a drug charge in Jersey City. For example, if a police officer did not have reasonable suspicion to stop and confront the individual who was ultimately found to be in possession of drugs, the charges may be able to be dismissed. Similarly, if the officer did not have probable cause to search the person found with drugs in their possession, the charges may be able to be dismissed.
Even if the drug charges are not able to be outright dismissed, our lawyers have significant experience in negotiating a resolution to a drug case—which often results in no jail time and in some cases, no criminal conviction. Obviously, the specific facts and circumstances of a drug case will ultimately determine how the case may be resolved.
