The attorneys at Clark & Noonan were able to obtain the dismissal of DWI charges against one of its clients in Ocean County, New Jersey. The client was charged with DWI after police alleged that the individual was under the influence of a narcotic while operating his vehicle. The charges were originally filed against the client in December of 2016.
Through pretrial motion practice the defense attorneys at Clark & Noonan were able to obtain the dismissal of all charges. In New Jersey, an individual who is convicted of DWI for operating a vehicle while under the influence of a narcotic will lose his or her license for a period of seven months on a first offense. A second offense carries a loss of license of two years and a third offense carries a loss of license of ten years as well as a mandatory minimum period of one hundred and eighty days in the county jail. The client was able to avoid any of the above described penalties upon the dismissal of the DWI charge.
