Mr. Clark has also successfully sought the suppression of evidence in a number of criminal cases in both superior and municipal courts, resulting in outright dismissals of the charges. In numerous other cases Mr. Clark, employing a number of pro-active investigative techniques, has obtained evidence that has exonerated his clients resulting in the dismissal of serious felony charges.

Mr. Clark’s expertise is not only limited to the criminal law, as he has also handled many cases in family court, including domestic violence restraining order cases, along with companion domestic violence criminal charges, and charges for contempt of a restraining order. He has litigated the dismissal of the vast majority of the restraining order and domestic violence criminal charges against his clients who were the defendant. Mr. Clark’s experience domestic violence matters has also led successful results for clients who were the victim of domestic violence by litigating the issuance of final restraining orders on their behalf and filing Tevis Claims in divorce proceedings.

Mr. Clark not only draws on his extensive experience as a partner at Clark, Clark & Noonan, LLC, but also on his experience as a prosecutor for the District Attorney of Queens County in New York City. As an Assistant District Attorney he handled thousands of misdemeanor cases, trying a number of them, including crimes for bias harassment, DWI/DUI, serious traffic violations, simple assault, and violations of restraining orders.

After his work on misdemeanor cases, Mr. Clark was promoted to the Major Crimes Career Criminal Bureau as a riding ADA where he worked hand in hand with the NYPD on hundreds of investigations which included crimes for murder, attempted murder, kidnapping, gun possession, drug possession, armed robbery, pattern robberies, bank robberies, commercial burglaries, residential burglaries, gang assault, felony assault, endangering the welfare of a child, and domestic violence. His duties as a rider also included advising the NYPD on search and seizure issues and drafting search warrants. It was here he was provided with a unique window into what the police do and don’t do in an investigation, and where the flaws in a prosecutor’s case are likely going to arise.

Mr. Clark completed his career as a prosecutor in a felony trial bureau where he handled more than a thousand felonies. While there he successfully tried a number of cases including crimes for aggravated assault, burglary, armed robbery, gun possession, and DUI/DWI. His trial experience included directing and cross examining expert witnesses in areas including blood to breath alcohol measuring instruments, and the reliability of witness memory in the area of identification.

Mr. Clark left the District Attorney’s Office in August of 2010 to partner with his brother Charles F. Clark Jr. who is also an accomplished trial attorney and former Monmouth County Assistant Prosecutor.
