I was summoned to appear in criminal court.  Does that mean I am considered a criminal?

The Aberdeen Municipal Court distinguishes between traffic violations and criminal violations.  If you have been charged with a non-traffic violation, your court appearance will be posted on the criminal schedule.  Criminal violations include shoplifting, disorderly persons violations, trespassing, drug possession, and other charges that do not involve traffic offenses (like speeding.)

Do I have to appear in court?

Yes.  If you have been accused of a criminal violation you must appear in Aberdeen Municipal Court on the date you were assigned by the court.   If you fail to show up on your court date, the court is required by law to take further action against you.  The judge will issue a warrant for your arrest and a bail amount will be assessed.  You may also be subject to additional fines and penalties.  If you were required to pay a fine and do not pay the fine by the due date, you could lose your driving privileges as well.

If a person has been charged with an indictable offense, the matter will not be heard in Aberdeen Municipal Court unless the matter is remanded by the Ocean County Prosecutor’s Office.

What if I missed my court date?  If I fail to appear in court will I be arrested?
